Introductory Article – Definitions

For the purposes of this document, each of the terms mentioned below shall have the meanings ascribed to them below:

  • Competition”: refers to the Competition called “World Tasting Championship” as organized by the RVF Company, and which will take place on October 11 and 12, 2024 in Margaux at the Château Dauzac ;
  • "Participant": refers to any individual person and/or group of persons in the case of representation of a country participating in the Competition;
  • « Account»: refers to the personal digital space made available to the User once he/she has registered, and after his/her username and password have been created;
  • « Website »: refers to the "www.worldtastingchampionship.com" Website published by RVF;
  • « User »: refers to any natural person of legal age holding an Account on the Website;
  • « Visitor»: refers to any natural person accessing and browsing the Website for consultation purposes, without holding an Account ;

Article 1 – Purpose of the Website

This document constitutes the General Terms and Conditions of Use (hereinafter the "T&Cs") of the Website, accessible at the www.worldtastingchampionship.com address, and which are intended to govern access to and use of the Website, as well as the terms and conditions of use of any service offered on the Website. And this, it being recalled that the Website relates to the World Tasting Championship as organized by the RVF (hereinafter the "Competition").

Article 2 – Acceptance of the General Terms and Conditions of Use

By accessing and using the Website, the Visitor and/or User/Participant is deemed to have read and thus accepted the T&Cs.

In the event that the Visitor and/or User/Participant does not accept these General Terms and Conditions, the latter must therefore stop browsing the Website.

The RVF reserves the right to refuse access to all or part of the Website to any Visitor and/or User/Participant who does not comply with them.

The RVF also reserves the right to make, at any time and without notice, any modification to the T&Cs and/or to all or part of the Website, including its terms of use, in particular for the purpose of complying with any legislative, regulatory and/or technical developments. And this without RVF being held liable in this regard.

The version of the T&Cs applicable is the one in force at the time of consultation by the Visitor and/or the User/Participant of the Website. It is therefore advisable before browsing and/or purchasing on it, to refer to the latest version of the T&Cs, which are available at all times on the Website.

Article 3. Compte WORLD TASTING CHAMPIONSHIP

                3.1 How to create the WORLD TASTING CHAMPIONSHIP Account

The creation of a WORLD TASTING CHAMPIONSHIP Account is reserved for any User/Participant who must have reached the legal age of majority in accordance with their place of residence.

Prior to the creation of an Account, the User/Participant is deemed to have read and thus accepted these T&Cs, their acceptance being expressly made by means of a checkbox provided for this purpose and appearing in the account creation form.

In order to be able to create their Account, the User/Participant has two registration options:

  1. Registering the Competition as a representative of a country

The User/Participant who wishes to register as a representative of a country is invited to submit his/her wish to register to the Competition committee, i.e. to the RVF.

When the application is accepted, the User/Participant will then receive login credentials allowing them to connect to their Account on the Website.

The User/Participant in charge of the registration is invited to proceed with the payment of the same, it being recalled that the price is broken down as follows:

      Number of participants in a team x Cost of individual entry into the Competition*

*The prizes are detailed and available on the Competition Website.

The User/Participant is then invited to fill in all the information of his team, in particular for each of the members of the team:

  1. Their first and last names;
  2. An individual presentation of each of the members;
  3. A photo;

The person in charge of providing such information undertakes to ensure that it is valid and up-to-date, which must in no way infringe the rights of third parties.

  1. Individual Registration for the Competition

As a preliminary point, all User/Participants are duly informed that participation in the Competition on an individual basis does not allow an identical participation to that which can be made in respect of a country. By participating individually, the User/Participant is invited to experience the Competition, and in particular the final of the Competition. And this, according to the Offers presented on this Website, either the Complete Pack or the "Final" Pack.

In order to register, the User/Participant is invited to directly fill in a form dedicated to this purpose, which requires the following to be completed:

  1. His Civility
  2. His first and last name
  3. A valid email address
  4. A password that complies with security requirements

The User/Participant undertakes to provide valid and up-to-date information, and does not infringe the rights of third parties.

Once the information has been entered, the User/Participant is invited to proceed with the payment of their registration.

  1. Payment and refund terms
  • - Payment terms

Payment for the Registration by Users/Participants is made by means of a credit card via the secure platform of the payment provider LYRA COLLECT.

Each User/Participant guarantees the RVF that he/she is fully authorized to use the payment card for the payment of their Registration, the RVF cannot be held responsible in the event of fraudulent use of the bank card used for said payment. Also, the RVF cannot be held liable in the event of a malfunction occurring on the LYRA COLLECT payment platform.

The payment methods are specific to the platform of the payment service provider LYRA COLLECT and are independent of the RVF, which does not intervene in any way whatsoever during it.

The security of payments is thus secured by LYRA COLLECT, as any transaction carried out between LYRA COLLECT and a User/Participant is encrypted. No bank data is kept by the RVF.

  • - Refund terms

In an undifferentiated manner, whether it is a Country or Individual Register, in the event of cancellation 60 (sixty) days before the Competition is held, Participants (individuals and/or teams) will be entitled to a refund of 50% of the amount paid for their Entry.

In the event of a cancellation less than 60 (sixty) days before, Participants will not be entitled to any refund.

3.2 Use of the WORLD TASTING CHAMPIONSHIP Account

By creating an Account and browsing the WORLD TASTING CHAMPIONSHIP Website, the User/Participant is deemed to have accepted and to have also read these T&Cs. Consequently, it is the responsibility of all User/Participant to exercise a certain degree of diligence, in particular with regard to the confidentiality of their username and password. In the event of loss, theft or fraudulent use of his/her identifiers, the User/Participant must immediately inform the RVF, and may, if required, ask the RVF to obtain new ones.

The User/Participant browsing the Website under his or her own username is therefore deemed to be exclusively responsible for any use of the Website made under it, and therefore excludes any liability of the RVF in the event of fraudulent use by a third party of the identifiers.

The RVF cannot therefore be held responsible for the use that may be made of the Account, and therefore reserves the right to suspend or delete the Account when necessary.

In addition, each of the publications envisaged by any User/Participant will be subject to prior validation by the RVF before their publication on the Website.

3.3 WORLD TASTING CHAMPIONSHIP Account Duration

The WORLD TASTING CHAMPIONSHIP Account is considered to be active until it is deleted, including:

  • - In the event of a request for deletion of the Account made by the User/Participant;
  • - In the event of non-compliant use by the User/Participant of his Account, and more generally in the event of any behaviour on his part contrary to these T&Cs, without prior notice;
  • - In the event of inactivity of the Account at the end of a period of 3 (three) years from its creation.
  1. Behavior of Visitors and/or Users of the Website

It is the responsibility of each Visitor/User to use the Website responsibly, as well as to respect the rights of any other third party.

The Visitor and/or User/Participant thus undertakes, and in a non-exhaustive manner, to:

  • Do not communicate your username and password;
  • Not to make comments that may be insulting, defamatory, contrary to good morals, or that may infringe on the privacy of a third party;
  • Not to make comments that could damage the reputation and brand image of the RVF, including those of other companies in the Marie Claire Group;
  • Not to use the Website for commercial, political, or religious purposes;
  • Not to make the content of the Website available to any third party, free of charge or for a fee;
  • Not to disturb the access and thus the peaceful enjoyment of the Website of any other Visitor and/or User;
  • Not to usurp or attempt to usurp in whole or in part the identity of a third party;

Thus, any behavior of a Visitor and/or User/Participant that turns out to be fraudulent and therefore contrary to these T&Cs is exposed to the risk of civil and/or criminal proceedings against him.

The RVF cannot therefore be held liable in the event of use contrary to the T&Cs, as well as to any service attached to the Website.

In addition, the RVF reserves the right to suspend or refuse access, without any notice or compensation, temporarily or permanently.

  1. Accessibility and Availability of the Website - Liability

The WORLD TASTING CHAMPIONSHIP Website is accessible via the internet on a permanent basis, i.e. 24 hours a day, 7 days a week.

The RVF will make every effort to ensure the proper and secure operation of the Website.

The Visitor and/or User/Participant is informed that it is technically impossible to provide the Website free of any defects, which may lead to the temporary unavailability of the Website.

The Visitor and/or the User/Participant is aware that the Internet is not a guarantee against any possible hazard, and thus the consequences that this could have on the Website.

The operation of the Website may be affected by events and/or elements over which RVF is not under its control, such as, for example, means of transmission and communication between RVF and the Visitor and/or User/Participant, as well as between RVF and other networks. The RVF and/or its suppliers may, at any time, modify or interrupt temporarily or permanently all or part of the Website to carry out maintenance operations and/or make improvements and/or modifications to the Website. The RVF will, if possible, inform the Visitor and/or User/Participant of any modification and/or interruption of the services available on the Website. The RVF cannot be held responsible for any modification, suspension or discontinuance of the Website.

Thus, and in a non-exhaustive manner, the RVF cannot be held liable in the event of:

  • Temporary interruptions to the Website, in particular when these are either required for maintenance and/or update purposes, or due to an interruption of telecommunications or electricity services, or due to a case of force majeure;
  • Malfunction(s) of the internet network, in particular concerning the communication of information;

The unavailability of the Website does not give rise to any right to compensation. More generally, the Visitor and/or the User/Participant may not claim any compensation of any kind whatsoever in all of the above-mentioned cases.

Any Visitor and/or User/Participant then undertakes, but not limited to:

  • - Ensure that it has all the technical and technological characteristics required to be able to access and use the Website;
  • - Ensure that they have taken all necessary measures to ensure the protection of their data and/or computer equipment (in particular their computer and/or software), in particular against any viruses and/or malicious digital content;

Furthermore, RVF cannot be held liable in the event of any direct or indirect damage that may be suffered by a third party, which may result from its browsing and/or use of the Website, regardless of the causes, nature and consequences that may result.

  1. Intellectual Property

                6.1 Website

The Website and each of its components (in particular its tree structure, trademarks, graphics, texts, photographs...) are subject to French and international legislation, in particular that relating to copyright and intellectual property.

All other trademarks mentioned are the property of their respective owners.

This Website respects copyright. All the rights of the authors of the protected works reproduced and communicated on this Website are reserved. Unless authorized, any use of the works other than individual and private reproduction and consultation is prohibited.

Access to the Website confers on any Visitor and/or User/Participant a strictly personal and private, non-exclusive, and non-collective right of use on it, and thus its content.

Any reproduction, representation, publication, transmission, or more generally any unauthorized use of the Website and/or its elements that may be made by the Visitor and/or the User/Participant will engage his liability, the latter may also be exposed to the risk of legal proceedings against him, in particular for infringement.

In addition, and in the context of publications to be created by a User/Participant, they must comply with all regulations and legislation in force, including those relating to copyright and personality rights (photographs displaying natural persons). In addition, each User/Participant is deemed to have transferred to the RVF all of his rights (in particular reproduction, representation, etc.) on each of his publications to be distributed on the Website as well as on all other media (in particular digital, paper, etc.), for the legal term of copyright protection.

                6.2 Links

The Website may contain links to other Websites that the RVF does not operate. The RVF cannot be held responsible in any way for the provision of these links allowing access to these Websites and external sources, and cannot bear any responsibility for the content, advertising, products, services or any other material available on or from these Websites or external sources that are neither verified nor approved by our teams.

As the use of the Website is reserved for strictly personal use, any link with this Website must be subject to prior authorization from the RVF. Thus, any so-called "framing" practice, i.e. the incorporation of a web page of the Website as well as any content appearing thereon within another third-party website and/or mobile application is prohibited.

  1. Partner Newsletters and Offers

                7.1 Newsletters

The RVF offers any Visitor and/or User/Participant the opportunity to receive, if they wish, its newsletters.

It is possible to subscribe to this newsletter at any time via the section provided for this purpose on any page of the Website and/or when creating an Account, which is not required to receive it.

The proposal for such an option is also carried out in compliance with the applicable regulations in force concerning the protection of personal data.

When creating an Account, the User/Participant is free to choose if he/she wishes to benefit from it by means of a checkbox provided for this purpose.

In the event that the Visitor and/or User/Participant wishes to unsubscribe from the newsletter, an unsubscribe link is available on each email communication sent to them.

                7.2 Partner Offers

When creating their Account, the User/Participant is invited, if they wish, and by means of a checkbox provided for this purpose, to accept offers from the RVF's partners, i.e. in particular exclusive offers, and/or good deals.

In the event that the User/Participant no longer wishes to receive them, an unsubscribe link is available on each email communication sent to them.

In addition, all offers proposed by the Partners are made under their sole and entire responsibility. In doing so, and in the event that a Visitor and/or User/Participant of the Website is required to enter into a contract with one of the latter, the RVF cannot be held liable for any cause(s) and/or foundation(s) whatsoever, the contractual relationship being solely and strictly concluded between the Partner and the Visitor and/or the User/Participant of the Website.

The Visitor and/or the User/Participant is informed that these T&Cs may in no way apply to the offers of partners, and by extension to any content that may be related to them.

  1. Personal data

RVF may collect and process the personal data of any User and/or Visitor when browsing the Website, and/or when creating or authenticating it to their account.

In this regard, the RVF therefore undertakes to respect and therefore comply with the regulations in force concerning the protection of the personal data of any Visitor and/or User.

Thus, and in accordance with both the French Data Protection Act of 6 January 1978 and the European General Data Protection Regulation 2016/679 of 27 April 2016, all Visitors and/or Users have the right to access, rectify, delete, oppose, data portability and limit processing.

  1. Applicable law

These T&Cs are subject to French law.

Any dispute that arises concerning the validity, interpretation, execution or termination of the T&Cs will be subject to the jurisdiction of the courts of Paris.
